RSJ Notched Another Win

RSJ attorneys Curt Roeder and Tim Johnson notched another win for a Minnesota Homeowner's Association whose insurance company significantly undervalued its storm damage claim.

The Association was affected by multiple wind and hail storms in the spring of 2012.  After the Association submitted a claim under its policy, its insurance company offered only $35,000 to fix the storm damage in spite of a $1.1 million estimate from its contractor.  The insurance company claimed that no significant wind or hail even passed over the property, completely ignoring visual evidence of severe hail damage to the townhomes, multiple hail reports in the area, and over 30 downed trees on the property.

The Association tried for nearly two years to negotiate the claim without success, and eventually hired RSJ in late 2014 to handle the insurance appraisal.  As soon as the snow melted, the appraisal hearing took place.   The appraisal panel conducted a site inspection, and both sides presented evidence.  RSJ's meteorologist confirmed golf ball size hail and winds in excess of 60 MPH, which corroborated the massive damage on-site.  After hearing both sides, the appraisal panel awarded the Association $960,000, more than 24 times the insurance company's offer to settle.
